Parakeet Primaries Trial License
Effective October 1, 2024 • Parakeet
The short of it: While you can’t use these icons in any published work, you can use them to create mockups.
- This trial license is between you, the user, and Parakeet, Inc. Parakeet owns the icons delivered with this trial license. You are a licensee.
- This trial license is non-exclusive and non-transferable. It takes effect when you download the icons. This license applies to the icons you received with this trial license and any free updates to the icons published by Parakeet. Parakeet reserves all rights not granted in this license.
- Initially, this trial license allows you to use the icons in any number of test products. In this testing phase, you can mock up as many apps, websites, or products as you want. And you can share those products with people for testing purposes as much as you want. But you may not use icons in any manner for non-testing purposes without first obtaining a paid license from Parakeet. You still need a paid license from Parakeet if your product is free.
- Even though these icons are for test purposes, there are still limits on how you may use them. Your use is subject to the following limitations:
- You may use “read-only” versions of the icons in digital files you create, including PDFs, e-books, software applications, and websites. “Read-only” means that users of your digital files can not install the icons to make new works using the icons.
- You may use the icons in physical items (e.g., signs, products, etc.). But you may not use the icons as primary branding elements (e.g., logos), app icons, social avatars, favicons, or similar uses. You also may not create physical embodiments of an icon (e.g., a 3D-printed version of the “couch” icon) or merchandise primarily featuring one or more icons (e.g., a sweatshirt with the “scooter” icon).
- If you want to use the icons for things you make on behalf of others (e.g., as a designer or developer doing client services work or as a subcontractor), you must obtain a paid license (even if what you provide to your client is for demonstration purposes).
- You may not sell or distribute the icons (or modified versions of the icons) for use by others. This also prohibits making the icons available for use by users within your application (even if the use is for demonstration or beta purposes).
- Any use of the icons in the above ways, whether or not for trial purposes, requires a paid license from Parakeet.
- You may modify the icons, but the modified versions remain subject to this trial license.
- This trial license remains in effect until terminated. If you purchase a paid license from Parakeet, that license governs your use. If you breach this trial license, it automatically terminates. If you have unusual or excessive technical-support needs, Parakeet can terminate your trial license. After termination, you must delete all copies you’ve made of the icons and remove the icons from your products. At Parakeet’s request, you must certify that you have done so.
- Oregon law governs this trial license. The state and federal courts serving Multnomah County, Oregon are the exclusive venues for resolving disputes related to this trial license.
- The prevailing party in any dispute regarding this trial license is entitled to recover from the non-prevailing party its reasonable legal fees and costs it incurred in the dispute and in any appeal.
- IMPORTANT! The icons are provided “AS IS”. You waive the implied warranty against infringement.
- ALSO IMPORTANT! Parakeet’s liability to you for damages arising from your use of the icons—including third-party claims against you—is limited to $10.
- If you downloaded the icons on behalf of an organization, the following terms also apply:
- An “organization” is an entity or association of people.
- All employees (but not contractors) of an organization may use the icons in the development of test products for the organization.
- The organization is responsible for breaches of this license by its employees and former employees.
- This is the entire license. This trial license can be changed only if we both agree in writing.
